auto accident occurred 4/23/14 in claim ******* in which ****** ****** is insured by Mendota.

Mendota refuses to pay claim.

The accident, caused by car insured by Mendota, resulted in total destruction of car driven by ***** ********** Claim # is ********

I am a Miami Senior Judge and Ms ********* is my clerk. She is unable to drive due to loss of her car. It has been more than two months and Mendota refuses to pay for the damage and refuses to return her calls. Mendota has given no reason for its failure to pay for the loss of the vehicle.

Desired Settlement

The insurance adjuster deemed the car a total loss. Ms. ********* wishes to receive payment from the insured. It has been more than 60 days from the date of the accident and Mendota will not explain why it has not paid the claim.

This serves to acknowledge receipt of the above captioned Consumer Complaint dated June 23, 2014. A review of our file indicates the consumer listed above, *********************, has been assisting Ms. ************** with the above captioned claim. Upon first notice of this automobile accident, Mendota Insurance Company was notified that the driver who was operating the insured vehicle was not listed on the policy. This warranted further investigation and both ******************************* were well informed of this throughout the claim process. Our records indicate consistent claim updates to either ****************************** on the following dates: 5/2, 5/13, 6/9, 6/24, 7/8 and 7/9.

The file was being handled under a Reservation of Rights and ***********a was placed on notice of her duty to mitigate damages while the investigation was in progress. Furthermore, the circumstances that developed as the investigation progressed resulted in Mendota Insurance Company conducting Examinations Under Oath by outside counsel of both the policy holder and the unlisted vehicle operator in order to determine coverage. In the interim we proceeded to inspect the vehicle damages and declared it a total loss.

We are pleased to inform that we have concluded our investigation and cleared coverage for this loss. Furthermore, ***********a was contacted in regards to our offer but the claim representative was unable to speak with her directly. We are awaiting her reply to our offer and anticipate this matter will be concluded amicably in the near future.
